What are the benefits of hiring an attorney to help with a tax controversy case?
Anytime you are in unfamiliar territory, it is helpful to have a guide. We use our experience and problem-solving skills to guide you through the tax resolution process and help you arrive at the best possible result. The other advantage of hiring an attorney is that you will not need to talk with the IRS. This both prevents you from making any misstatements and gives us more control over how we present information to the IRS.
Can a tax attorney reduce the amount of tax I owe?
It is possible, but we cannot guarantee any specific result, and it depends on the type of case and the facts and circumstances of the case. We will help review your options, including ones that may result in reducing the amount you owe, along with our assessment of your chances of success and any associated risks. You have control over which option is selected for your case, and we then help carry out that option to the best of our ability.
If I hire you, will I have to talk to the IRS?
No. We serve as your point of contact with the IRS, so you never have to talk to them.
Do you prepare tax returns?
No. But we are happy to provide a referral.
Getting Started
When should I consider hiring a tax attorney?
If you are receiving tax notices, either indicating that you are under audit, or showing a balance due that you do not agree with or unable to pay, you should consider calling a tax attorney to discuss your case and review your options.
How do I schedule a consultation?
You can schedule by clicking the following link to schedule a phone consultation.
What type of information do I need at my consultation?
Along with the basic facts and history of your tax issue, the best item to have ready are any notices you have received from the IRS.
Do you offer free consultations?
We charge a nominal fee for 30-minute consultations because valuable information on case status and your options are provided during the consultation.
Fees & Billing
How do you charge—hourly, flat fee, or contingency?
We ask for retainer payments (pre-payment for a certain number of hours) up front and then bill hourly against that retainer. When the retainer is below $1,000, we will ask for replenishment of the retainer to continue representation. The total cost of representation depends on the complexity and difficulty of the case, and how much time is needed to resolve it.
Do you charge for phone calls and emails?
Yes. All such communication adds value to the case and is billable at our regular hourly rates.
What is the minimum billing increment you use?
The minimum billing increment is 6 minutes, or .1 hours.
Communication & Process
How does tax representation work?
The first step is typically reviewing any correspondence from the IRS, reviewing your IRS tax transcripts, and confirming the exact nature of the problem. The next step is typically preparing a submission which may include forms, a narrative, and supporting documentation, and presenting it to the IRS. After receiving the IRS’s response, we review and either submit additional information, appeal, or try a different strategy entirely. We may go through several rounds of submission and response before the case closes.
How often will you update me on my case?
Update frequency varies depending on the stage of the case. For cases that are waiting on the IRS, the maximum length between updates is 30-45 days. For all others, updates are more frequent.
Privacy & Confidentiality
Is everything I tell you confidential?
Yes
Is everything subject to attorney client privilege?
Yes, assuming we meet the requirements of privilege and it is not waived.
Practical
Do you take emergency or urgent cases?
Yes. Sign up for a consultation and let’s get to work.
Can you represent me if I live in another state?
Yes. We can work on IRS matters and IL matters regardless of your state of residence. However, we only take non-Illinois tax controversy cases on a case-by-case basis.
